摘　　要：最有利于未成年人原则是我国法律对《儿童权利公约》规定的“儿童最大利益原则”的本土化表达。《家庭教育促进法》虽然在文本上未直接规定这一原则,但是其总纲中的第5条实质性体现了最有利于未成年人原则的核心内容,由此限定了父母家庭教育权的行使。在《家庭教育促进法》第二章的内容中,父母行使家庭教育权的方式是以承担家庭教育责任的形式呈现的,充分说明了父母的家庭教育权与家庭教育责任互为一体。基于此,在《家庭教育促进法》实施以后,父母应当在依法行使家庭教育权的过程中,熟悉家庭教育责任并承担家庭教育责任不履行的后果。The principle of the best interests of minors is the localized expression of the"principle of the best interests of the child"stipulated in the United Nations Convention on the Rights of the Child in Chinese law.Although the Law on the Promotion of Family Education does not directly stipulate this principle,Article 5 of its general outline substantively embodies the core content of this principle,thereby limiting the exercise of parents'right to family education.In Chapter II of the Law on the Promotion of Family Education,the way in which parents exercise the right to family education is in the form of assuming responsibility for family education,which fully explains the relationship between the right to family education and the responsibility of family education.Based on this,after the implementation of the Family Education Promotion Law,parents should familiarize themselves with the responsibilities of family education and bear the consequences of failing to perform their family education responsibilities in the process of exercising their right to family education in accordance with the law.
