《教师法》修订可以通过司法反哺立法——兼评《教师法修订草案(征求意见稿)》

摘　　要：立法是司法的基础,司法也可反哺立法,并促使立法在发现和解决问题的过程中不断走向完善。通过分析120起援引《教师法》的诉讼案件发现,《教师法》在适用过程中暴露了调整范围局促、寒暑假薪酬标准模糊、体罚行为欠缺操作界定、处分解聘规则不周延及救济规则滞后于法治进程等问题。为此,《教师法》修订应将培训机构教师与外籍教师纳入法律调整范围,明确寒暑假薪酬标准和条件,对体罚和惩戒进行操作界分,将师德规范转化为法律要求,构建适应教师队伍状况的多元解纷机制。适用层面的审视虽然可以揭示现有法条的不足,却无法完整反映党中央对教师队伍建设的新要求和新期待。要系统修订《教师法》,不仅要纠正现有法条的问题,也要吸纳政策精神创设新规,保证修法的系统完整和精准高质。Legislation is the basis of judicature.Judicature can also feed back legislation,and promote the perfection of legislation in finding and solving problems.Through the analysis of 120 lawsuit cases cited in Teachers'Law,it is found that some problems,such as narrow adjustment scope,vague salary standard in winter and summer vacation,insufficient operation definition of corporal punishment,improper punishment and dismissal rules,and lagging behind the rule of law.Therefore,the revision of the law should face up to the problems and take precise measures,bring discipline training and foreign teachers into the scope of adjustment,make clear the salary standards and conditions in winter and summer vacation,distinguish the operation of corporal punishment and punishment,transform the norms of teachers'ethics into legal requirements,and construct a diversified dispute resolution mechanism suitable for the situation of teachers.Although the application level can reveal the problems and deficiencies of the existing laws and regulations,it can not fully reflect the new requirements and expectations of the Party Central Committee for the construction of teaching staff.To systematically revise the Teachers'law,we should not only correct the problems existing in the existing laws,but also absorb the spirit of the policy to create new regulations to ensure the integrity,accuracy and high quality of the law revision system.
