摘 要:在企业的深化改革中,我国实行了一系列的劳动合同法制,使得企业的用工管理方式也随之改变。与此同时,劳动关系的终止也日益受到人们的重视。近些年,因用人单位与员工对终止劳动合同适用的法定情形及办理方式存在分歧,由此引起的劳动纠纷数量呈上升趋势,已对企业的正常生产和运营造成了很大的影响。针对国有企业的现实情况,讨论双方在劳动合同终止与解除时可能出现的争议,并就终止与解除劳动合同的处理方式进行了阐述。In the deepening reform of enterprises in China,a series of labor contract laws have been implemented,which has led to changes in the employment management methods of enterprises.At the same time,the termination of labor relations is increasingly valued by people.In recent years,there have been disagreements between employers and employees regarding the legal circumstances and handling methods for terminating labor contracts,resulting in an increasing number of labor disputes,which have had a significant impact on the normal production and operation of enterprises.In response to the reality of state-owned enterprises,this paper discusses the possible disputes that may arise between the two parties when terminating and rescinding labor contracts,and elaborates on the handling methods for terminating and rescinding labor contracts.
