行政诉讼重作判决的适用困境与纾解路径

摘　　要：重作判决是一项具有中国特色的给付类从属判决。实践中,重作判决的适用存在适用要件不完善和裁判形式不明确等困境。这不仅影响重作判决制度功能的发挥,也造成了重作判决与其他判决类型的混淆适用以及界分困难。重作判决的适用要件可归结为前提性要件、必要性要件、可能性要件,即被诉行政行为被撤销或确认无效、被诉行政行为或争议法律关系须被重新处理、被诉行政机关具备法定职责且具有重作可能性。在裁判形式方面,根据司法审查有限原则,同时兼顾救济实效性,重作判决应以程序性裁判为原则,以指示性裁判为补充。关于重作判决与其他判决类型的界分,不履行法定职责类案件应适用履行判决而非重作判决,重作判决与变更判决则是一般与例外的关系。Remaking judgment is a kind of subordinate payment judgment with Chinese characteristics.In practice,there are difficulties in the application of remaking judgment,such as incomplete application requirements and unclear form of judgment.This not only affects the functioning of the remaking judgment system,but also causes confusion and difficulty in distinguishing between remaking judgment and other types of judgments.The application requirements of remaking judgment can be summed up in the logical structure of the preceding element,necessity element,possibility element,that is,the accused administrative act is revoked or confirmed invalid,the accused administrative act or the disputed legal relationship must be re-handled,and the accused administrative organ has legal duty and has the possibility of remake.In terms of the form of judgment,according to the principle of limited judicial review and considering the effectiveness of relief,remaking judgment should be based on the principle of procedural judgment and supplemented by indicative judgment.As for the distinction between remaking judgment and other types of judgments,the case of non-performance of legal duties should be applied to the performing judgment rather than remaking judgment,and the relationship between remaking judgment and changing judgment is general and exceptional.
