摘　　要：翻译是跨文化交流的重要途径,译作体现着译者的智力劳动,在性质上属于受著作权法保护的演绎作品,具有独特的独创性认定标准及著作权保护价值。翻译作品著作权侵权源于原作的较大市场需求与后译者的不当攀附。随着翻译技术的迭代,其侵权现象愈发隐蔽,这一点在“公版书”领域尤为明显。结合译作的翻译学特点,在认定翻译作品侵权时,需要首先认定“接触”条件的成立,而后排除无独创性的通用或惯常表达,判断后译者是否存在对原译个性化表达和错漏衍夺等非通用因素的袭用,以此实现精准判定翻译作品侵权、维护译者权利和保障翻译领域创新发展的整体目标。Translation serves as a crucial avenue for cross-cultural communication,with translated works reflecting the intellectual labor of translators.By nature,translations are derivative works protected by copyright law,possessing unique criteria for originality determination and value for copyright protection.Copyright infringement of translated works arises from the significant market demand for original works and the improper appropriation by subsequent translators.With the iteration of translation technology,instances of infringement become increasingly covert,particularly evident in the realm of“public domain books”.Considering the characteristics of translated works,the determination of copyright infringement necessitates adherence to industry standards,safeguarding innovative translation expressions,and accommodating the development of translation technology as guiding principles.When specifically identifying infringement of translated works,it is essential to first establish the condition of“contact”and then exclude non-original generic or customary expressions.Furthermore,judgment should be passed on whether subsequent translators have employed personalized expressions and rectified errors and omissions,thereby achieving precise determination of copyright infringement in translated works,safeguarding the rights of translators,and ensuring the overall goal of promoting innovation and development in the field of translation.
