高校在线教学视域下版权合理使用问题研究

摘  要:在线教学作为一种新型教学模式因缺少相应立法设计而面临着侵权风险,尤为突出的是作为抗辩理由的版权合理使用制度的适用争议。从版权法合理使用制度的价值取向,教育技术发展下课堂教学质量保障的客观需求,以及文化创新与传播的促进等角度来分析,高校在线教学具有寻求版权法中合理使用制度适用的内在需求和价值正当性,故而从理念的转变、标准的调整以及版权补偿等尝试对高校在线教学适用合理使用制度的路径探索,在线教学的合理使用制度的考量正是寻求互联网时代新的利益平衡,在判定在线教学是否适用合理使用时,应当进行的是价值判定而非规则的相符性的考量。基于此,借鉴“四要素”法进一步释明概括性条款且拓展规则性条款的内容,同时赋予在线教学平台及平台使用者“注意义务”,并基于在线教学运行机制分类适用版权补偿金,实现版权多方利益平衡。Online teaching,as a new teaching model,faces the risk of infringement due to the lack of corresponding legislative design.What is particularly prominent is the application of the copyright fair use system as a defense.Analyzed from the value of the copyright law fair use system,the objective demand for quality assurance of classroom teaching,the particularity of the subject of higher education and the promotion of cultural innovation,online teaching in colleges has the ability to seek fair use in the copyright law.The inherent needs and value legitimacy of the application of the system,so from the change of ideas,the adjustment of standards,and copyright compensation,try to explore the path of applying the fair use system to online teaching in colleges.Balance of interests,when judging whether online teaching is suitable for fair use,what should be done is a value judgment rather than a consideration of compliance with the rules.Based on this,drawing on the"four elements"method to further clarify the general terms and expand the content of the regular terms,supplemented by the"duty of care"of the platform,and apply the copyright compensation based on the online teaching operating mechanism.Entrust multiple subjects with certain obligations to achieve a balance of multiple copyright interests.
