摘  要:罪错未成年人分级干预机制下,各项干预措施能否被科学、准确适用在很大程度上决定了罪错未成年人教育矫治的最终效果。专门教育措施在适用上存在评估适用不当与外部衔接不当两方面实践难题,在参照规范供给相对不足的情况下,有必要首先确立专业性原则,定期评估原则以及比例原则为后续具体规则的制定以及实践中相关问题的解决提供指引,同时应当明确以行为人为中心的评估导向,改良专门教育指导委员会工作组织方式,建立定期评估工作机制,完善社会化处遇措施配套机制,拓展专门学校功能以及完善专门学校与刑事司法程序的衔接机制,以保证专门教育措施在司法实践中被合理适用。Under the hierarchical intervention mechanism for juvenile delinquents,the scientific and accurate application of intervention measures determines the effectiveness of education and correction for juvenile delinquents.There are two practical problems in the application of special education measures:improper evaluation and insufficient external coordination.Due to the lack of reference norms,it is necessary to establish principles of professionalism,legular avaluation,and proportionality to guide the formulation of specific rules and solve related problems.At the same time,an actor-centered evaluation should be clarified.Special education advisory committees should optimize their functions,and a regular evaluation mechanism should be established.It is also essential to improve the support mechanisms for socialized treatment measures,expand the functions of specialized schools,and strengthen the coordination between specialized schools and criminal justice procedures to ensure the appropriate application of specialized education measures in judicial practice.
