摘 要:涉外仲裁人才培养是仲裁行业深化改革与建设国际仲裁中心的内在要求,也是推动共建“一带一路”高质量发展,形成对外开放新格局的应有之义。近年来,我国仲裁事业获得了飞速发展,但是涉外仲裁人才队伍仍然匮乏,人才队伍建设仍受培养渠道不系统、体制机制不健全、法治环境不完善等因素制约。本文认为,优化涉外仲裁人才的培养路径,可以分短期、中期、长期分别进行讨论和设计。短期上,需要解决人才供应端敞口,通过建立人才库和仲裁机构人才基地,迅速汇集人才优势。中期上,需要建立专业教育体系,完善涉外法学专业学科设置,创新涉外法治人才培养模式。长期上,需要加强统筹规划,继续推动仲裁行业的市场化和法治化改革。The cultivation of foreign-related arbitration talent is the inherent requirement of deepening the reform of the arbitration industry and building an international arbitration center,and it is also the due meaning of promoting the high-quality development of the“Belt and Road”and forming a new pattern of opening up.In recent years,China’s arbitration industry has achieved rapid development,but the foreign-related arbitration talent team is still lacking,and the construction of talent team is still restricted by such factors as unsystematic training channels,imperfect system and mechanism,and improved rule of law environment.This paper holds that the optimization of the cultivation path of foreign-related arbitration talent can be discussed and designed in the short,medium and long term respectively.In the short term,it is necessary to solve the talent supply side exposure,and quickly gather talent advantages by establishing a talent pool and a talent base for arbitration institutions.In the medium term,it is necessary to establish a professional education system,improve the curriculum of foreign-related law,and innovate the cultivation mode of foreign-related rule of law talent.In the long run,it is necessary to strengthen overall planning and continue to promote the market-oriented and rule of law reform of the arbitration industry.
