国际公务员与法学院高质量涉外人才培养——兼论法学院《国际组织和国际公务员》课程因应设计

摘  要:积极参与全球治理既是世界对中国的召唤,也是中国向世界贡献中国方案的时机。国际公务员将成为中国法学院高质量涉外人才培养的新风口。法律人才在国际组织既可从事一般事务工作,也可从事具有专业门槛的法律专业性的工作。中国应加大国际公务员中法律人才的输送。但中国学生(包括法科生)对国际组织体系、国际公务员制度、相关文书写作及竞聘流程等缺乏系统性学习,这对高校向国际组织输送人才或形成障碍。因应高校培养国际公务员的时代之需,文章提出《国际组织和国际公务员》课程设计有必要性和紧迫性。国内师资较缺乏国际组织实务经验。为此,文章建议中国政府应强化现有国际组织人才资助体系,将高校教师(特别法学教师队伍)全面纳入国际组织的政府职员借调项目,教师保留现有教职,全职进入国际组织承担中层及以上管理工作,或者非管理的顾问岗位工作,在其回归高校后建立对应的晋升等配套优惠政策,以吸引更多优秀人才充实到国际组织人才培养的教师队伍。Actively participating in global governance is not only the world's call for China,but also an opportunity for China to contribute to the world's global governance by injecting Chinese schemes.Hence,law schools in China are to be directed to cultivate international civil servants,which are synonymous with high-quality international talents.Legal talents can engage in general work in international organizations,but also in legal professional work.However,Chinese students(including law ones)generally lack a systematic understanding of international organizations and international civil servants,and there is a lack of training in formal writing and recruitment procedures as well.All these create an obstacle for Chinese students to apply for international organization positions.In considering these challenges,a course titled International Organizations and International Civil Servants is of great necessity and a matter of urgency.However,most Chinese teachers if not all lack practical work experience of international organizations,which shall affect the course teaching.To address these issues,it is suggested that the Chinese government should consolidate the pre-existing secondment programs in international organizations.Currently,the secondment programs are mainly targeted at government officials,so they should be expanded to recruit university academic staff members working in the international organizations through secondment programs by undertaking middle and above-level management positions,or serving as senior non-management consultants.The university academic staff members have the right to return to their original employment.It is also suggested that after return to the sending universities from the receiving international organizations,preferential policies such as promotion from the former should be established,through which more high-end university staff members can be more motivated to participate in cultivation of international civil servants.
