摘　　要：全面抗战时期,中共在坚持独立自主发展方针的前提下,通过与国民党谈判、反对国民党制造的磨擦及联合其他抗日党派等途径的斗争,争取自身合法地位。虽然国民党始终不愿也没有从法律层面承认中共合法,但中共在上述斗争中坚持原则的坚定性与策略的灵活性,保障了自身生存发展的空间,在一定程度上获得了事实上的合法地位,成为抗日战争的中流砥柱,对全民族抗战的胜利作出重要贡献,并最终发展为“决定中国命运”的“最强有力的政治力量”。On the premise of adhering to the policy of independent development,the Communist Party of China(CPC)fought for its legal status through various ways during the Total Anti-Japanese War,which included negotiating with the Kuomintang,opposing the friction and uniting with other anti-Japanese parties.Although the Kuomintang never admitted the legal status of CPC in the legal level,CPC insisted the firmness of principle and flexibility of strategic in the struggle,which guaranteed the space of survival and development and obtained the legal status on the factual level.CPC become the mainstay of the Anti-Japanese War,made important contributions to the victory of war,and eventually developed into“the most powerful political power which decide the fate of China”in the struggle for legal status.
