摘  要:新质生产力对用工模式产生着深刻影响,依托数字平台的新就业形态劳动者已成为我国劳动力市场的重要组成部分。囿于资产数据化下的“自我劳动”趋势、个人利益异质化下的集体认同感丧失等特殊性,该群体在个别劳动法视阈下的权益保障落入真空地带,集体协商制度的适用成为解决此问题的全新进路。但赋权的缺失、权利义务主体的嬗变、代表性的弱化及制度适用的异化削弱了集体协商制度的适用效能。未来新就业形态劳动者集体协商的制度建构应在利益失衡矫正的视角下,实现具有人权属性的集体协商权对个别劳动关系的超越,通过集体协商权利义务主体的释明、法定程序下的代表性保障以及集体协商的分阶段推进,实现制度范式的优化。The rise of new quality productive forces has profoundly impacted the transformation of employment models.Workers in emerging employment forms,which rely on digital platforms,have become a vital component of China’s labor market.Due to the unique characteristics of this group,such as the trend toward “self-labor” in the context of data-driven assets and the loss of collective identity under individual interest diversification,the protection of the rights and interests of this group under the threshold of individual labor law has fallen into a vacuum.The application of collective bargaining mechanisms presents a new approach to addressing this issue.However,the lack of empowerment,the transformation of rights and obligations among stakeholders,the weakening of representation,and the distortion of the system’s applicability have undermined the effectiveness of the collective bargaining system.The future construction of a collective bargaining system for workers in new forms of employment should aim to transcend individual labor relations by realizing the collective bargaining rights as human rights attributes within a perspective of correcting imbalanced interests.This can be achieved through clarification of the stakeholders of rights and obligations in collective bargaining,guaranteeing representation under statutory procedures,and promoting the phased implementation of collective bargaining to optimize the system paradigm.
