摘　　要：新时代我国犯罪学在犯罪概念内涵的认识论层面做到与刑事制定法区别对待的同时,犯罪概念外延界定的方法论至少应当在四个维度进行深层次变革。一是用发展的观点科学认定犯罪行为;二是明晰国内外犯罪概念界定差异点,并构建中国特色的犯罪行为认定方法论;三是用联系的眼光看待犯罪外延,在犯罪行为预防、规制、惩戒所发挥的作用层面,刑法学和犯罪学的效力范围可以说多有重合而各有侧重点;犯罪学层面的功能性犯罪定义论无从消弭刑事制定法的独有价值;对犯罪行为的规范作用要求在犯罪学和刑事制定法中形成跨学科联动机制;四是犯罪学视阈下,理论上做到精确无误地把握犯罪概念的方法论尚且不存在,更遑论客观现实,但方法论自应当尽力为之。In the new era,while distinguishing the epistemological level of understanding the connotation of the concept of crime from criminal statutory law in criminology in China,the methodology for defining the extension of the concept of crime should undergo in-depth changes in at least four dimensions.Firstly,criminal acts should be scientifically identified from a developmental perspective.Secondly,the differences in the definition of the concept of crime between China and foreign countries should be clarified,and a methodology for identifying criminal acts with Chinese characteristics should be constructed.Thirdly,the extension of crime should be viewed from a relational perspective.In terms of the roles played by crime prevention,regulation,and punishment,the scopes of validity of criminal law and criminology can be said to overlap significantly yet have their own focuses.The functional definition of crime at the criminological level cannot eliminate the unique value of criminal statutory law.The normative role of criminal acts requires the formation of an interdisciplinary linkage mechanism between criminology and criminal statutory law.Fourthly,from the criminological perspective,there is no methodology that theoretically guarantees an accurate grasp of the concept of crime,let alone in objective reality,but methodology should strive for it as much as possible.
