行政复议与行政诉讼衔接重点问题探讨

摘　　要：行政复议与行政诉讼都是行政争议解决机制的重要组成部分,但在制度特点、功能定位等方面有一定的不同,前者是化解行政争议的“主渠道”,后者是化解行政争议的“最后防线”。本文结合2023年修订的《行政复议法》确立的各项制度,从功能定位、受案范围、程序选择、实质审查、争议化解等五个方面,对行政复议与行政诉讼衔接有关重点问题进行探讨。本文认为,推动行政复议与行政诉讼两项制度有效衔接,对于更好发挥行政复议化解行政争议的主渠道作用和行政诉讼司法最终审查作用,具有十分重要的意义。应当与时俱进完善制度机制,贯彻实施好有关法律制度,逐步推动行政复议、行政诉讼在化解行政争议方面形成分工合理、衔接有序、协同高效、优势互补的合理格局。Administrative reconsideration and administrative litigation are both important components of the administrative dispute resolution mechanism,but there are certain differences in terms of system characteristics and functional positioning,the former is the“main channel”for resolving administrative disputes,and the latter is the“last line of defense”for resolving administrative disputes.Based on the various systems established by the newly revised Administrative Reconsideration Law,this paper discusses the key issues related to the connection between administrative reconsideration and administrative litigation from five aspects:functional positioning,scope of cases,selection of procedures,substantive examination,and dispute resolution.This article argues that it is of great significance to promote the effective connection between the two systems of administrative reconsideration and administrative litigation to better play the role of administrative reconsideration as the main channel for resolving administrative disputes and the role of administrative litigation in the final judicial review.It is necessary to keep pace with the times,improve systems and mechanisms,implement the relevant legal systems,and gradually promote the formation of a reasonable division of labor,orderly cohesion,efficient coordination,and complementary advantages in administrative reconsideration and administrative litigation in resolving administrative disputes.
