论促进科技成果转化法的进一步修订与完善——基于促进我国高校科技成果转化的视角

摘　　要：2015年修订的《中华人民共和国促进科技成果转化法》,重点破解了科技成果转化过程中的制度性问题,对高校科技成果转化工作起到了重要的推动作用。高校设置的管理科技成果转化的机构更加专业,相关规范文件逐步完善,科技成果转化的成效显著提升。但该科技成果转化法对于高校科技成果的权属、义务和机构制度以及政府和企业在高校科技成果转化中的作用等方面的规定存在问题。文章借鉴美国和日本促进高校科技成果转化的法律经验,建议启动对该科技成果转化法的修订并制定专门法律,适当突破高校科技成果权属的规定,进一步明确高校科技成果转化义务,完善关于高校科技成果转化机构的规定,增加高校科技成果转化中政府责任和企业作用的规定,提升高校科技成果转化的效率和质量。The Law of the People's Republic of China on Promoting the Transformation of Scientific and Technological Achievements which was revised in 2015,has largely promoted the transformation of scientific and technological achievements in universities by solving the institutional problems that negatively affect the process mentioned above.The management institutions for universities are more professional,the relevant normative documents are gradually improved,and the actual results of the transformation of scientific and technological achievements are more and more remarkable.However,there are some problems in the new"Transformation Law"concerning the ownership,obligation,institution system and the role of government and enterprises in terms of regulation.Drawing on the legal experience of the United States and Japan in solving the above problem,it is suggested to start the revision of the"Transformation Law"and the enactment of special laws,appropriately break through the ownership on the ownership of scientific and technological achievements in universities,further clarify the obligations,improve the regulations on institutions in the universities,and set more regulations on the responsibilities of the government and the role of enterprises in order to improve the efficiency and quality of the transformation of scientific and technological achievements.
