摘  要:教育法典总则在整个法典中起着统领性作用,发挥着价值引领、通用标准、体系补全等规范功能。从教育主体和教育行为两个维度,教育法典的总则应包括基本规定、学校及其他教育机构、教师及其他教育工作者、受教育者、教育管理、教育保障、教育对外交流与合作等内容。对教育法典总则规范的提炼,首先要从宪法中的教育基本规定出发,对现有教育法律法规进行整合归纳,同时结合教育法理论和教育治理发展趋势进行适度创设,构建起科学、完备的总则体系,为后期分则的编纂打好基础,提供依据。The general provisions in the education code play a leading role throughout the code and perform normative functions such as value guidance, general standards, and system supplementation. From the two dimensions of educational subjects and educational behaviors, the general provisions of the education code should include basic regulations, schools and other educational institutions, teachers and other educational workers, educatees, educational management, educational support, and educational foreign exchanges and cooperation, etc. To refine the norms of the general provisions in the education code, it is first necessary to start from the basic educational provisions in the Constitution, integrate and summarize the existing educational laws and regulations, and at the same time, moderately create in combination with educational law theories and the development trend of educational governance, so as to construct a scientific and complete general provisions system, laying a good foundation and providing a basis for the compilation of the specific provisions at a later stage.
