摘  要:传统的教育与学习模式在数字化时代发生了重大革新,既有的公民教育权益保障制度面临新的挑战。公民教育权益保障的传统规范构造模式,主要遵循受教育权保障逻辑,并已形成稳定的规范体系与理论范式。随着教育数字化的深入推进,这种权益保障逻辑难以回应新的权利诉求,学习权作为一种新的权益保障逻辑应被提出。学习权保障逻辑强调“以教为中心”向“以学为中心”的转变,更加契合数字化时代公民教育权益保障的实质内涵。对此,可以通过教育法典编纂来明确学习权的法律地位,同时推动学习权对受教育权保障理论的创新发展,还要从国家义务、企业与平台义务等多元维度出发强化对学习权的体系化保障。In the digital era,traditional education and learning modes have undergone a major innovation,and the existing system of safeguarding citizens’rights and interests in education is facing new challenges.The traditional normative construction mode of safeguarding citizens’rights and interests in education mainly follows the logic of safeguarding the right to education and has formed a stable normative system and theoretical paradigm.With the deepening of education digitization,it is difficult for this logic of protection to respond to new claims,and the right to learn as a new logic of protection should be put forward.The logic of protection to the right to learn emphasizes the change from“teaching-centered”to“learning-centered”,which is more in line with the substantive connotation of the protection of citizens’rights and interests in education in the digital era.In this regard,the legal status of the right to learn can be clarified through the codification of the education code,while promoting the innovative development of the theory of the right to learn on the protection of the right to education,and strengthening the systematic protection of the right to learn from the obligations of the state,enterprises and platforms,and other dimensions.
