论数据法教学的三重思维体系构建

摘  要:与传统部门法教学相比,数据法教学具有以法学规范分析为教学核心、以课堂讲授和案例研讨为主等的共性内容,又突出了数据法教学与数据科学、计算机科学高度融合以及产学研一体化等个性特征。数据法教学需要建立法律思维、科技思维和伦理思维“三位一体”的教学思维体系。数据法教学的法律思维以数据法概念为教学起点,以数据法规范体系为教学架构,以数据法案例进行法律思维训练。数据法教学的科技思维以计算思维挖掘数据法中的数量关系,以工程思维实现数据法的规模化应用,以实验思维创新数据法治应用模拟。数据法教学的伦理思维以课程思政激发数据法伦理的育人功能,以科技向善理念引导学生树立正确的数据法职业价值观,以多维度考核体系检验数据法伦理的实践应用。Compared with traditional areas of law teaching,data law teaching has common contents such as taking legal normative analysis as the core of teaching,lectures and case studies as the main content,but also highlights the characteristics such as high degree of integration with data science and computer science and the integration of industry,academia and research.Data law teaching requires the establishment of a“triple”teaching thinking system of legal thinking,scientific and technological thinking and ethical thinking.The legal thinking of data law teaching takes the concept of data law as the starting point of teaching,the normative system of data law as the teaching structure,and this legal thinking is trained by the legal thinking training with data law cases.The scientific and technological thinking of data law teaching takes computational thinking to explore the quantitative relationship in data law,the engineering thinking to realize the scale application of data law,and the experimental thinking to innovate the simulation of data law application.The ethical thinking of data law teaching stimulates the educational function of data law ethics with curriculum ideology and politics,guides students to establish correct professional values of data law with the concept of science and technology for the good,and tests the practical application of data law ethics with a multi⁃dimensional assessment system.
