摘 要:尽管“冻卵案”已于2024年尘埃落定,但该案涉及的单身女性社会性冻卵问题仍未走出困境。围绕这些困境形成了两种对立的观点,论争能否放宽冻卵限制。分析发现,生育权属于人的自然权利,不应被传统观念束缚;关于“自由之争”,应摒弃对冻卵技术背景下生育自由的单向度理解,基于生命伦理学的基本原则重新对其予以明确;陈旧的禁止条例在表述层面逻辑关系不明,在性质层面含混不清,在效力层面不可作为直接法律依据。唯有多维度澄清单身女性社会性冻卵的正当性,才可能推动多元价值下社会共识的建构和立法保护的完善,由此保障单身女性的基本权利。Although"The Egg Freezing Case"was settled in 2024,the issue of social egg freezing rights of single women that the case highlighted remains unresolved.This debate has given rise to two opposing views on whether the limitations on egg freezing could be relaxed.Analysis shows that reproductive rights are natural rights that should not be constrained by traditional norms.Regarding the"freedom debate",the one-dimensional understanding of reproductive freedom in the context of eggfreezing technology should be discarded,and its definition should be clarified based on the fundamental principles of bioethics.Outdated prohibitions are logically unclear in their wording,ambiguous in their nature,and ineffective as direct legal grounds.Only by clarifying the legitimacy of social egg freezing for single women from a multi-dimensional perspective,can society build consensus on diverse values,improve legislative protections,and safeguard the fundamental rights of single women.
