摘　　要：附条件不起诉是轻微犯罪出罪的重要方式,数字技术在辅助量刑预测、羁束检察裁量、个性化监督矫治等方面发挥的作用有助于全面激活附条件不起诉的适用。但数字时代下附条件不起诉制度也面临技术和伦理层面的双重困境,突围之路在于明晰数字化评估与不起诉裁量间既联袂互动又适度分离的关系,在运用数字技术前主动开示数据并提供救济管道,寻求数字化监督考察平台的多部门联通共建。数字时代下附条件不起诉的程序改良宜从运用数字技术辅助识别适用条件出发,依靠数字技术呈现“可视化”的公共利益并严格限制裁量权,同时加强个性化考察模块开发的规范供给。Conditional non-prosecution serves as a crucial procedural mechanism for the exclusion of minor offenses from prosecution.The integration of digital technologies,such as predictive sentencing,the constraint of prosecutorial discretion,and personalized correctional supervision,can effectively invigorate the application of conditional non-prosecution in its entirety.However,the digital age also presents both technical and ethical dilemmas for the institution of conditional non-prosecution.The route to resolution is predicated on delineating a dynamic interplay,yet an appropriate separation between digital evaluation and non-prosecutorial discretion,thereby necessitating advanced data disclosure and sustenance of remedy channels prior to the deployment of digital technology,and simultaneously advocating for the multi-departmental collaboration to create an oversight platform powered by digitalization.The procedural refinement of conditional non-prosecution in the digital age could ideally commence from the structured progression of initiation elements,by depending on digital technology to actualize a“visualized”public interest and to strictly contain discretionary power,whilst concurrently amplifying the standard provision of the development of personalized inspection modules.
