职业学校学生实习权益保障的法治困境与优化建议——基于221份裁判文书的分析

摘　　要：本研究基于内容分析法,以中国裁判文书网221份判决文书为样本,利用Nvivo12软件对文本进行整理、编码和分析。研究结果发现,职业学校学生的实习权益面临着人身权益受到侵害、实习生与实习单位法律关系的模糊、相关责任主体不作为和乱作为、实习生的权益存在救济困境、实习生法律维权能力薄弱等各种法治困境。为此,立法上要完善相关法律法规,健全配套实习保障政策;执法上要建立行政执法协同机制,加大有关部门执法力度;司法上要健全维权救济制度,加强对实习生的司法救济;守法上要提升学校与实习单位守法意识,强化学生法律素养与能力。Based on the content analysis,this study takes 221 documents from China Judgments Online as samples,and uses NVIVO 12 software to organize,encode and analyze the text.The results show that the internship rights and interests of vocational school students are faced with legal difficulties such as infringement of personal rights and interests,vagueness of legal relationship between interns and internship institutes,inaction and disorderly actions of relevant responsible subjects,relief dilemma of interns’rights and interests,and interns’weak ability to protect their legal rights.Therefore,in terms of legislation,it is necessary to improve the relevant laws and regulations and perfect the supporting internship security policy;in terms of enforcement,it is necessary to establish a cooperative administrative enforcement mechanism and require strict enforcement by relevant departments;in terms of justice,it is necessary to improve the redress system and strengthen judicial redress for interns;in terms of law-abiding,it is necessary to enhance the schools’and the internship institutes’awareness to abide by the law and strengthen students’legal literacy and ability.
