高校实验室政府采购合同风险管理探究

摘　　要：为了做好高校实验室政府采购合同的风险防控,提高实验室资金使用效益,实现实验室管理提质增效,通过分析高校实验室政府采购合同现状、现行法律法规制度框架和内容、实验室合同标准文本及典型案例,提出了高校实验室政府采购合同管理的风险防控策略与建议。高校实验室政府采购合同应分阶段做好不同环节的风险防控。在合同准备阶段,要做好人员控制、程序控制和时间控制;在合同签署阶段,要确保合同条款完善、内容严谨、签订合规、公开规范;在合同履行阶段,要建立健全履行监督审查机制、纠纷处理机制、档案管理机制以及合同履行评估机制。Aiming at the risk management of government procurement contract of university laboratories,the prevention and control strategies of different risk links are studied.By analyzing the current situation of government procurement contract in university laboratories,the framework and content of current laws and regulations,and the standard text of laboratory contract,this paper puts forward the risk prevention and control strategies and suggestions for the management of government procurement contract in university laboratories,and carries out strategic analysis and application through typical cases.We innovatively study different risk links,risk factors,risk probabilities,legal responsibilities,and prevention and control strategies.It puts forward the personnel control,program control and time control in the contract preparation stage.In the contract signing stage,it should ensure that the terms are perfect,the content is rigorous,the signing of compliance,open norms.In the stage of contract performance,it should establish and improve the supervision and review mechanism,dispute handling mechanism,file management mechanism,contract performance evaluation mechanism and other solutions,aiming to provide theoretical support and practical guidance for the risk management of government procurement contract in university laboratories.
