摘 要:联合国《儿童权利公约》及其第5条为理解国家与父母或其他照料者之间在家庭教育领域的关系提供了一种新的范式。我国2021年颁布的《家庭教育促进法》,既是对实践中家庭教育存在的问题和社会关切的回应,也是落实《儿童权利公约》的积极举措,反映了该公约倡导的新儿童观和儿童发展框架。从儿童权利的角度看待《家庭教育促进法》的规则构建,该法符合《儿童权利公约》及其第5条以儿童为中心,全方位、多主体共同保障儿童权利、促进儿童发展的立场。在家庭内部以及全社会对提高家庭教育与促进儿童权利的意义的认识是实施《家庭教育促进法》的关键,特别是在构建家庭教育服务体系和司法干预过程都应尊重儿童权利主体地位,基于儿童身心健康和能力不断发展的特性,坚持儿童最大利益、非歧视等基本原则,为家庭教育领域儿童权利的实现提供全面的支持和保障。The United Nations Convention on the Rights of the Child(CRC)and its article 5 provide a new paradigm for understanding the relationship between the State and parents or other guardians in the area of family education.In 2021,China enacted the Family Education Promotion Law,which is both a response to the problems and social concerns of family education in practice and a positive step towards the implementation of CRC reflecting the new concept of the child and the framework for children's development.Analyzing the rule construction of the Family Education Promotion Law from the perspective of children's rights,it is found that the Law is in line with the CRC and its Article 5,especially with child at its center and emphasizing the rights-oriented approach.The Law advocates comprehensive and multi-actors'joint efforts to safeguard the rights of the child and to promote children's development.Raising awareness within the family and in society as a whole of the significance of family education in promoting the protection of children's rights is key to the implementation of the Family Education Promotion Law.In particular,in the construction of the family education service system and in the judicial intervention process,it is necessary to respect the status of the children as the rights holders,based on the characteristics of the their physical and mental conditions and the continuous development of their individual abilities,adhering to the basic principles of the best interests of the child and non-discrimination,and with an aim to provide comprehensive support and safeguards for the realization of the rights of the child in the field of family education.
