摘  要:教育惩戒在维护中小学教育秩序、保障校园安全及促进学生正确价值观的形成方面不可或缺。司法案例揭示,实践中的教育惩戒主要表现为变相体罚与惩戒不作为两种形态。惩戒广泛存在于课堂教学与课外活动中,涉及身体惩罚与心理惩戒两种方式。教育惩戒立法存在理念定位失当、系统性和协调性不足、惩戒合理与过当界定模糊、救济程序不完善等诸多不足之处。为此,秉持服务教育目的,遵循明确性和合理性原则,兼顾个性化差异,坚守惩戒合理性底线;构建实体与程序双轨并行且相互支持的规范体系,通过强化教师专业培训,提高法治意识,共同推动中小学教育惩戒制度的健全和完善。Educational punishment is indispensable for maintaining the educational order in primary and secondary schools,ensuring campus safety,and promoting the formation of students'correct values.Judicial cases reveal that in practice,educational punishment mainly takes the forms of disguised corporal punishment and inaction in punishment.Punishment widely exists in classroom teaching and extracurricular activities,involving both physical punishment and psychological punishment.There are many deficiencies in the legislation of educational punishment,such as improper positioning of concepts,lack of systematicness and coordination,vague definition of reasonable and excessive punishment,and imperfect relief procedures.Therefore,it is recommended to adhere to the purpose of serving education,follow the principles of clarity and rationality,take into account individual differences,and stick to the bottom line of reasonable punishment.Construct a regulatory system with parallel and mutually supportive entities and procedures.By strengthening teachers'professional training and raising their awareness of the rule of law,jointly promote the improvement and perfection of the educational punishment system in primary and secondary schools.
