“国家在场”视角下曲艺普法的行动逻辑与完善路径——以X县曲艺普法者F某为个案分析

摘　　要：加强全民普法不仅是法治社会建设的重要内容,也是全面依法治国的重要环节。作为全民普法主体的一元,曲艺普法者成长于特定的社会语境和社会实践,构成了法治国家建构的本土资源,其普法行动逻辑依赖“国家在场”而前行。本文从动态层面阐释曲艺普法的功能逻辑,即曲艺普法作为一种民间普法力量,不但在理论上具有普法叙事功效,也在实践中承担着一定的道德教化功能。就前者而言,曲艺普法通过诗歌性的语言诉说法律文本的内容意义,并得以在法律文本、曲艺普法者与听众的多重视域互动中克服前见,促进视域融合;于后者而论,曲艺普法能够回应当地群众的生活实际需要,为国家法治现代化建设提供基础性支持,有助于巩固和促进人民的法治信仰与国家认同,赋能诉源治理。鉴于曲艺普法在行动过程中面临宣传广度覆盖不足与内容深度挖掘不够的双重困境,故在法治现代化的进程中,应当突出当前我国法治社会建设中的“国家在场”优势,尊重和关切曲艺普法的路径走向,以寻求官方法治宣传教育与民间曲艺普法力量之间的融通与共治。Strengthening universal legal education is not only an important part of the construction of a rule of law society,but also an important link in the comprehensive rule of law.As the main body of universal legal education,Quyi legal education practitioners grow up in specific social contexts and practices,forming the local resources for the construction of a rule of law country.Their legal education action path relies on the presence of the state to move forward.This article explains the functional logic of Quyi popularization of law from a dynamic perspective.As a folk popularization of law force,Quyi popularization of law not only has the narrative function of popularizing law in theory,but also undertakes certain moral education functions in practice.As for the former,Quyi popularizing law tells the content meaning of legal text through poetic language,and can overcome the preconceptions and promote the horizon fusion in the interaction of legal text,Quyi popularizing law and audience.As for the latter,Quyi popularization of law can respond to the actual needs of local people’s lives,provide basic support for the modernization of the country’s rule of law,as well as helping consolidate and promote people’s belief in the rule of law and national identity,and empowering litigation source governance.Given the dual dilemma of insufficient coverage and depth of content exploration in the promotion of Quyi popularization of law in the process of action,in the process of modernizing the rule of law,we should highlight the advantage of“state presence”in the current construction of a rule of law society in China,respect and care about the path and direction of popularizing folk art and legal education,in order to seek the integration and co governance between official legal publicity and the power of popularizing folk art and legal education.
