摘 要:由于学前教育在产品属性、教育对象、儿童权利、教育原则以及教师劳动等方面具有不同于其他学段的特殊性,这种特殊性是区别于其他教育阶段的本质属性,彰显了学前教育的独特价值,是学前教育立法的逻辑起点。学前教育的特殊性在现实中被遮蔽,需要通过学前教育立法保护并彰显学前教育的特殊性:坚持公益普惠的性质定位,明确政府主体责任;凸显儿童权利保护的核心价值追求,捍卫儿童游戏权;明晰幼儿园教师的法律地位,保障合法权益;禁止“小学化”,保障良好的入学准备。Since preschool education is different from other stages of school education in properties,educational objects,children's rights,educational principles and teachers'labor,this particularity is an essential attribute distinguishing from other stages of education,which highlights the unique value of preschool education and constitutes the logical starting point of preschool educational legislation.However,the particularity of preschool education is obscured in reality,which needs to be protected and highlighted by preschool education legislation:to adhere to the nature of public welfare and clarify the main responsibility of the government,to emphasize the core value of protecting children's rights and defend their rights to play,to clarify the legal status of kindergartners and protect their legitimate rights and interests,to prohibit“primary school-oriented nursery education”and ensure a sound school readiness.
