摘 要:食品安全一直是社会关注的焦点,尤其就食品供应链而言,一旦发生食品安全事件,往往牵扯多方主体而较为复杂。本文以第三方物流运输企业在运输过程中发生的食品安全事件为例,通过深入解读法律法规、剖析总结行政执法案例,揭示供应链各环节主体的风险点,探讨主体间义务边界与法律责任认定问题,并提出了应对危机事件的具体措施和建议。此外,本文还强调了供应链合规管理的重要性,建议企业从被动防御转为主动防范,建立完善的食品安全体系等。食品供应链中各方主体不仅应当严格履行法定义务,在危机事件发生之时及时采取应对措施,厘清责任边界,也应加强供应链日常合规管理,以有效防范和应对食品安全风险。Food safety remains a paramount concern for the public,particularly in the context of supply chains,where crises frequently involve multiple parties and present complex challenges.This article delves into food safety incidents that occur during transportation,specifically those involving third-party providers.By analyzing legal regulations and reviewing numerous enforcement cases,it identifies risk points across different segments of the supply chain and explores the delineation of obligations and legal liability among stakeholders.Moreover,this article proposes methods of crisis management.This article further emphasizes the importance of compliance management in supply chains and positive attitudes on facing crisis.The supply chain participants should not only fulfil their statutory obligations and be aware of their liability boundaries in the event of a crisis but also strengthen routine compliance management to effectively mitigate and respond to food safety risks,thereby ensuring the integrity and safety of the food supply chain.
