摘 要:教育公平是宪法平等权在教育领域的具体化,也是受教育权内含的价值基础。高等教育的迅速普及使得不同高校的发展差异显现,为了缓解就业压力与增加社会评价,高等教育的培育功能与社会功能开始逐步分化,办学主体的价值理性被漠视,而偏重于工具理性。政府作为宪法实施的主体,在教育领域的施政举措应当承担因维护平等权保障所必要的社会成本与法律责任,使得受教者的背景差异性被认真对待。具体而言,一是通过优化资源分配完善物质给付,二是塑造公平机制实现制度给付,借由高等教育的内涵式发展推动宪法规范中的抽象平等转化为现实可感知的具体平等。Educational equity is the concretization of the constitutional right to equality in the field of education and the value basis embedded in the right to education.The rapid development of education has intensified the heterogeneity between different higher education institutions.In order to alleviate the employment pressure and increase social evaluation,the cultivation function and social function of higher education have gradually begun to be divided,and the value rationality of the main body of education has been disregarded in favor of instrumental rationality.This paper considers that the government,as the main body of constitutional implementation,should balance efficiency and equity in its governance initiatives in the field of education,and play a leading role in creating an equal social environment so that the differences in the backgrounds of educated people are taken seriously.In particular,the government should improve the material payment by optimizing the allocation of resources,and the institutional payment by shaping the fair mechanism,so that the abstract equality in the constitutional norms can be transformed into the concrete equality that can be achievable through the meaningful development of higher education.
