摘　　要：鉴定式案例分析试题是建立合乎逻辑的法律适用思维方式的有效教学手段。据此,考生应按照法释义学的要求,将案件事实蕴含于法律条文之中,并在个别法律条文存在漏洞时,综合运用法律续造方法,找到合乎法秩序要求的适用结论。以民法请求权案例分析试题为例,考生应首先拟制设问句,之后按照与意思自治原则的关系亲远,依次审查请求权基础,并在审查每一个请求权是否成立时,又从其是否自始产生、是否嗣后消灭、是否可得实现三者层层推进。在此期间,考生不仅要严格依照法律进行涵摄适用,而且要注意发现法律漏洞,以进行必要的法律续造。出题人应着重加大设问句、法律漏洞和法律续造三个方面的论证分值,突出考查考生的实操能力。The appraisal-style case analysis examination is an effective teaching means to establish a logical way of thinking for the application of law.Accordingly,candidates should,in accordance with the requirements of legal dogmatics,incorporate the facts of the case into the legal provisions.When there are loopholes in individual legal provisions,they should comprehensively use methods of legal renewal to find an applicable conclusion that meets the requirements of the legal order.Taking civil law claim case analysis examination as an example,candidates should first formulate a question sentence.Then,in accordance with the closeness of the relationship with the principle of freedom of will,they should review the claims step by step.When reviewing whether each claim is established,they should also proceed layer by layer from whether it is generated from the beginning,whether it has been extinguished later,and whether it can be realized.During this period,candidates should not only strictly apply the law according to the rules of subsumption but also pay attention to discovering legal loopholes to carry out necessary legal renewal.The question setters should focus on increasing the argumentation scores of the question sentences,legal loopholes,and legal renewal,highlighting the examination of the candidates’practical operation ability.
