摘　　要：普洱茶作为云南省重要产业,其质量和声誉依赖于地理标志法律保护。通过规范分析法和比较研究法,对普洱茶地理标志的概念、现行保护模式、标准体系和管理体制进行分析,发现其标准体系重叠、不完整,管理体制存在多头管理和权利主体不清等问题。因此,需制定《地理标志保护法》,构建统一保护体系,完善标准体系,以提升普洱茶地理标志产品的质量和市场竞争力。As an important industry in Yunnan Province,the quality and reputation of Pu'er tea depend on the legal protection of geographical indications.Through the normative analysis method and comparative study method,the concept of Pu'er tea geographical indication,the current protection mode,the standard system and the management system are analyzed,and it is found that its standard system is overlapping and incomplete,and the management system has the problems of multi-head management and unclear right subject.It is concluded that it is necessary to formulate the Law on the Protection of Geographical Indications,construct a unified protection system and improve the standard system in order to enhance the quality and market competitiveness of Pu'er tea geographical indication products.
