英美合同法“对价”原则探讨

摘　　要：在国际经贸活动中,在与英美法系国家的当事人订立合同时,有一个重要的原则应当予以注意,因为它直接影响到合同的效力问题,这就是"对价"原则。该原则与我国合同法中的"等价有偿"原则相似,但不尽相同。借鉴英美合同法"对价"原则,有助于加强我国的外贸工作。In international trade affairs,the principle of compensabilities must not be neglected when concluding a contract with the parties from countries subject to BritishAmerican Law.this principle,which is roushly equal to China s mutual benefit,detemines the effectiveness of a contract.This paper makes a comparison between the two sets of laws to guide the parties in foreign trade.
