摘　　要：刑事诉讼的发展过程中 ,人权保障和犯罪追究成为不可或缺的两大价值取向。人类走向民主和文明的进程 ,反映在刑事诉讼中就是人权保障的观念逐步取代单纯的犯罪追究。我国刑事诉讼改革顺应了这一发展趋势。对疑案处理历史的回顾及理论分析 。In the process of the development of criminal procedure, security of human rights and punishment of offense become two indispensable value outlook. The advancement of democracy and civilization of human shows that security of human rights take the place of punishment of offense in criminal offense step by step. The reform of criminal procedure in our country is in accordance with such a trend. Therefore, it is significant for the perfection of judicial system in our country to look back at the historical development of the treatment of doubtful cases and to analyze it theoretically.
