摘　　要：缔约过失责任的法律基础是诚实信用原则。缔约过失责任应是一种独立的民事责任。本文分析了缔约过失责任的构成要件以及表现类型 ,阐明了我国合同法确立缔约过失责任制度的意义。The law base for the duty of treaty fault is the principle of honesty and credit.The duty of treaty fault should be a single civil liability.This paper analyses the forming of the duty of treaty fault and its expression types,explaining the meaning that contract law estabulishes the system of the duty of treaty fault.
