摘 要:由于我国现行商品房预售合同登记备案制度仅具有行政管理的性质,不具有民法上对抗第三人的效力,导致实践中一房二卖等纠纷层出不穷。为此,应当运用物权法的理论,提出应建立商品房预告登记制度,赋予商品房预售登记以物权的对抗效力,以此约束预售人,保护预购人,并妥善解决此类纠纷。Because the current pre - sold commercial house register system in our country is of the administrative nature and it has not the civil law effect to antagonize the third party,so many disputes,for example,the owner selling the house twice and two buyers asserting the right, have emerged in endlessl. Based on the principles of the property law,this article puts forward that commercial house forenotice register system should be established and have the effect of antagonizing the third parties to bind the pre - seller,protect the buyer and resolve the disputes appropriately.
