摘　　要：学界把诱惑侦查的对象界定为有"犯罪意图"的人。有"犯罪意图"的人可以分为两类:一是连续犯;另一是从来没有实施过犯罪行为,只是暂时有"犯罪意图"的人。前者当然可以作为诱惑侦查的对象,但把后者也作为诱惑侦查的对象就值得商榷,因为这在刑事诉讼理论、刑罚理论、犯罪心理学、法哲学及侦查实践等诸多方面都会受到挑战和质疑。The object of the encouragement is determined as people who have criminal intention by academic circles. However, people who have criminal intention can be classified into two types： continuous criminals and people who never commit crime, and only temporarily has criminal intention, the former is certainly the object of the encouragement, but the latter deserve argument, because it is challenged and questioned by criminal theories, penalty theories, criminal psychology, jurisprudence, practice and so on.
