良法生成的路径分析

摘　　要：从价值论意义而言,当代中国正在进行的法治建设应该是良法之治。为了确保所创制的法律为良法,必须科学设定良法的应然性目标体系,有效推进价值和规范层面的道德向法律的转化,这是良法生成的路径所在。From the sense of value, the rule of law which was building in contemporary China should be the rule of good laws. To ensure the laws to be good laws, we should set the target system of inevitability of the good laws scientifically, and promote the change from moral to legal in the level of value and rule effectively. This was the pathway of making good laws.
