“父子相隐”与告亲的正义性问题

摘　　要：孔子说的"父子相隐"之"隐"系沉默不言之义,"直"指明辨是非,"直躬"指明辨是非、品行刚正,"直在其中"指有"明辨是非"的成分。告亲的行为具有内在的道德缺陷,这涉及对亲属的伤害与家庭良心的匮乏。柏拉图笔下的苏格拉底也认为告父并非"虔敬",这种不虔敬性来自告父行为的自身具有非正义属性。不做不利于自己亲属的举告而知情沉默,道德与法律当予之以谅解或宽容,从而不强制或鼓励以直接伤害亲属来实现社会正义及道德崇高。Confucius said, ＂The father and son screen each other from blame＂, ＂screen＂ mean that keep silence, and ＂straight＂ mean that makes a clear distinction between right and wrong, ＂Upright Kung＂ mean making a clear distinction between right and wrong and moral good. ＂Involve a sort of uprightness＂ has composition of ＂making a clear distinction between right and wrong＂. The act of parenthood accusation has inherent morals defects, this involves of injury to the relative and shortage of family＇s conscience. Socrates in the works of the Plato thought that accused father was not ＂pious＂. This impiety come from the unjust attribute in the act of parenthood accusation. In the ethics situations that family are accused of or will be accused of, someone does not furnish the evidence which unfavorable to own family, and keep silence in the know, morals and law ought to forgive or tolerate it.
