摘 要:报应性惩罚观与功利性惩罚观分别把公正性、功利性作为教育中惩罚合理性的首要根据,具有一定合理性,但二者都没有把违纪学生的身心发展当作最终目的。教育惩罚观将教育性作为惩罚的中轴,这要求惩罚以一定的情感为基础,指向违纪学生,在道德层次上消减违规动机,保护学生的探索本性。公正性、功利性围绕着教育性这一中轴,惩罚才不会远离学生的发展。The ideal of retributive punishment and the ideal of utilitarian punishment respectively regard justice, utility as primary basis for the rationality of punishment in education, which has some rationality. But the common defect between them lies in they both fail to regard the discipline-breaking students' physical and mental development as the ultimate end. The concept educational punishment regards the education nature as the central axis of punishment, which requires punishment base on emotion, direct discipline-breaking students, subtract motivation of violation on moral level, protect student's explore nature. Only justice and utility encircle this central axis can't they be far away from students.
