摘 要:目前国内普遍存在严重的就业歧视现象,就业歧视不仅是一个经济问题;而且是一个社会问题;更是一个法律问题。建立和完善我国反就业歧视的法律制度,是根治就业歧视、维护公民平等就业、实现社会公平、公正的当务之急。现从就业歧视的界定入手,在分析我国现有立法不完善的情况,并从实体方面和程序方面为我国反就业歧视立法提出一些完善措施。At present, employment discrimination is serious and exists on a large scale in China, which is regarded not only as an economic and social problem, but also as a legal problem. Therefore, the establishment of and perfection of the laws against employment discrimination becomes an urgent task in order to remove employment discrimination, maintain equal employment and realize social fairness and justice. On the basis of the definition of employment discrimination, this paper intends to analyze the incomplete legislation system in China and puts forward some measures to perfect the legislation of anti-employment discrimination in the aspect of entity and procedure.
