高职院校校企合作主体权利义务及违约救济研究

摘　　要：文章针对当前校企合作中合作主体的权利义务及违约救济问题进行了深入的分析,提出了高职院校校企合作为平等主体之间的民事法律关系,存在互相提供教学与实践资源的义务,其救济途径亦应遵循合同关系的法律规定等观点。This article, based on an analysis of the rights and obligations for the subjects of cooperation be- tween vocational colleges and enterprises as well as the remedial measures for breach of contracts, advocates that vocational colleges and enterprises, as two equal subjects in civil legal relationship, are obliged to exchange teaching and practice resources and that the remedial measures should also conform to the corresponding laws and regulations.
