摘 要:2012年末异地高考政策的出台备受各界关注。尽管各地异地高考政策的差异较大,但异地高考的门槛已逐步放开,随迁子女参加流入城市的高考已是大势所趋。然而,异地高考政策能否成为实现"教育公平"的突破口?异地高考政策如何才能有效执行?如何为公民的平等受教育权设置相应的法律救济途径?这些问题需要我们冷静思考和理性分析。异地高考政策的推行是一个在依法行政的背景下因地制宜、循序渐进的综合性改革,其执行也需要配置充分的行政保障和司法救济渠道。唯有此,异地高考政策保障公民平等受教育权之价值目标才能真正得以实现。In the end of 2012, the policy of college entrance examination away from native places has drawn the attention of all social circles. Although there are many differences in such policies in different provinces, the threshold to the college-entrance examination has already been lowered to allow the children with their migrated par- ents to take part in the entrance examination of the city they move into. However, can the policy really be the breakthrough point to realize the educational equality? How can the policy be effectively implemented? How can the legal remedies be established to safeguard the citizens' right to education? These questions require us to think calmly and analyze reasonably. The implementation of the policy is a complex reform which should be carried out according to law and local conditions step by step. The policy should be given sufficient administrative guarantee and judicial remedies. Only in this way can the policy help to realize the goal of protecting the equal right to education.
