摘 要:高校人事制度变迁导致公立高校与教师法律关系性质的转变。教师法律地位由"国家干部"的公职属性向市场契约化转变,并同时具有私法上"劳动者"的双重特性。法律地位决定了教师教育活动中权利配置与义务履行的实际状态,也明确了教师权利救济的有效途径。基于此,社会法作为第三法域结合了"公法"与"私法"的属性,并融合了高校教师法律地位双重特质。本文尝试以社会法理念为视角,将公立高校教师界定为"特殊劳动者",通过教师法律地位遵循的基本原则、利益观、权利观及人事争议立法调整模式进行厘清与解构。A transition of personnel system in higher education does often lead to a shift in the nature of the legal relationship between public universities and the teachers.As to the teachers’ legal status,it has been undergoing a transformation from an attribute of public office tagged"the national cadre"to market contract,and has dual characteristics of a"laborer"from the perspective of private law.Legal status not only determines the actual circumstances of allocation of rights and fulfillment of obligations while the teacher undertakes his educational activities,but it also makes clear about the teacher’s effective access to right relief.Based on this,the legal unit of social law involves a combination of the attributes of public law and private law,and also it integrates some peculiarities of the dual characteristics within college teachers’ legal status.The paper aims to research from the perspective of ideas and concepts in social law,and attempts to define teachers in public universities as"special laborers",thus finally to clarify and deconstruct legal status oriented problems through adherent basic principles,concepts of rights & obligations,interest guarantee and legislation adjustment for personnel disputes.
