摘 要:师生关系不应当被简单地概括为"民主平等",平等也不宜被迷信与过度追捧。从平等与差别的内涵来看,法律上的平等与差别是规范意义上的,特指法律上的相同对待与差别对待。从法律的性质和内容来看,各个国家、各个时期的法律,都既规定与保护平等,也规定与保护差别。法律上的平等与差别都有其价值与合理性。从现实法律来看,师生之间既存在平等的方面,也存在差别的方面。师生法律上的平等与差别主要表现为:师生人格上的平等与身份上的差别,师生法律适用上的平等与法律内容上的差别,师生生活关系上的平等与工作关系上的差别。The relationship between teachers and students should not be simply summed up as democracy and equal- ity, and equality should not be overly believed and pursued. From the perspective of the connotation, the equality and difference in law is used in the normative meaning, and they specially refer to same treatment and different treatment. From the perspective of the nature and content, the law in every country and every period not only stipu- lates and protects same treatment, but also stipulates and protects different treatment. Either of the same treatment and the different treatment in law has its value and rationality. From the perspective of actual law, there are same treatments and different treatments between teachers and students at the same time. The same treatments and differ- ent treatments are as follows: They are similarly treated in personality, and differently treated in identity. They are similarly ruled by law, but they have different rights and obligations in law. They have unequal relation in work and equal relation in life.
