摘 要:韩非在《解老》《喻老》两篇中,对老子的思想进行了创造性的诠释,并在此基础上,对法家理论进行了建构。韩非在诠释老子的"道"时,引出了"理"的概念,由"道"及"理",为君主实施立法治国寻求理论根据;在诠释老子的"德"时,将老子的"形上之德"转变为"形下之德",以此来引导民众守法保身。韩非子借《喻老》强调君处尊势,并在重释老子的"道"与"德"的过程中,展现其"法术势"一体的法家思想体系。Han Fei gives a creative interpretation on Lao Tzu's philosophy in Jie Lao and Yu Lao. Based on this point,he builds the construction of Legalism theory. The concept of "Li"is brought when he explains "Tao". From "Li"to "Tao",which aims to seek the theoretical basis of legislation and governing management for the monarch. When explaining Lao Tzu's "De",he transforms the metaphysical "De"into the concrete "De"in order to persuade people to obey the law. Han emphasizes the nobility of the monarch by using Yu Lao and reinterprets Lao Tzu's "Dao"and "De"during the process of it,which presents the Legalist ideological system of integrating the thoughts of "law,technique and power "into one.
