摘  要:改革开放四十年来,我国的教育法治事业取得了重大成就:教育立法从空白到初步成型,教育行政从主要依靠政策向依法治教转变,教育民事司法发生过重大突破,教育行政司法的大门逐步打开。虽然面临立法资源不足、质量不高、执法强制性差、司法依据不足等问题,教育法治作为全面依法治国方略的重要组成部分,有望在民办教育分类管理、教师人事制度改革两方面率先突破。After 40 years of reform and opening up,the cause of rule of law in China's education has made great progress:Education legislation develops from blank to preliminary shaping,education administration from mainly relying on policy changes to managing education according to law,major breakthroughs in education civil justice occur,the door to education administrative litigation gradually opens.Although faced with problems such as insufficient legislative resources,poor coercive power and lack of judicial basis,as a part of the strategy of fully governing the country according to law,it is expected to take the lead in two aspects,which are private education classification management and teacher personnel system reform.
