摘 要:以往对侦查讯问方法的研究大多是从如何使用证据、说服教育、利用矛盾、情感感化等角度切入的。而从某种意义上来说,由于侦查讯问行为自身具有与谈判相似的某些特性,侦查讯问也可以理解为是一种特殊的谈判。另一方面,随着法治的日趋完善与诉讼模式的深刻变革,完全凭借权力对讯问对象进行压制的“纠问”式讯问方法越来越失去生存空间。借助智慧、策略、技巧的理性审讯方式使得审讯更趋近于一种特殊的谈判了。从谈判这一个新的视角切入,结合侦查实践中的案例,以期带给侦查讯问方法研究一些新的启迪。In the past,most researches on investigation and interrogation methods have been cut from the perspectives of how to use evidence,persuade education,use contradictions,and emotional influence. In a sense,due to the investigation and interrogation behavior itself has certain characteristics similar to the negotiation,it can be understood as a special kind of negotiation. On the other hand,with the improvement of the rule of law and the profound reform of the litigation mode,the interrogation method,which relies entirely on the power to suppress the interrogation objects,has increasingly lost its living space. With the rational interrogation of wisdom,strategy and skill,the trial is more closer to a special kind of negotiation. From the new perspective of negotiation,combined with the cases in the investigation practice,it is expected to bring some new enlightenment to the study on the investigation and interrogation method.
