摘  要:义务教育教师聘任合同在各地的适用,与《教师法》第十七条的规定出现了一定程度的"脱轨"现象,以致陷入严重的合法性困境。对地方教育立法的规范分析显示,地方教育立法难以弥合中央教育立法规定与各地教育实践表达之间的鸿沟,因此有必要对中央与地方教育立法制度进行反思。为构建良好的中央与地方教育立法关系,中央教育立法应秉持谦抑原则,地方教育试点也应遵循合法性原则。同时,教育法律的政策化倾向亟待修正,这同样是中央与地方教育立法关系法治化的应有之义。The application of teachers’ employment contracts in various places derails the provision of Article 17 of the"Teachers’ Law",which results in a serious legitimacy dilemma. A normative analysis of local educational legislation reveals that it is difficult to bridge the gap between central educational legislation and educational practice. So,it is necessary to rethink the central and local educational legislative system. To build a harmonious central and local educational legislative relationship,the central educational legislation should uphold the principle of modesty,educational local pilot project should also follow the principle of legitimacy.Simultaneously,the policy orientation of educational legislation needs to be amended,which is also within the legalization of the relationship between the central and local educational legislation.
