摘  要:对重庆市8所公立高校的人事代理文本进行研读发现,新旧问题的交汇重叠使中国高校人事代理制度的改革面临新的生存考验,造成制度优势难以彰显、制度公平备受挑战、代理教师专业自主发展及其权利保障遭遇危机等困境。基于新制度主义“合法性”原理,分析高校人事代理运行背后的深层动因,可知高校人事代理的实施是政府强意义下的政策推动和高校弱意义下的利益驱动联合催生的,但由于缺乏基础性制度资源的投入,目前的人事代理制度改革仍属于第二层次供给,尚不具备重建公立高校“社会契约人”战略目标的能力。对此,可尝试从强化制度伦理、增加制度供给和引入法治路径等方面对中国高校人事代理制度进行优化改造,推进高校教师合理流动。Through the study of the personnel agency texts of 8 public universities in Chongqing,this paper finds that the overlap of new and old problems makes the reform of personnel agency system in colleges and universities face a new survival test,and thus it is difficult to highlight the advantages of the system,the fairness of the system is challenged,and the professional independent development of acting teachers and the protection of their rights are in crisis.Based on the principle of“legitimacy”of new institutionalism,it analyzes the deep causes behind the predicament of personnel agency operation and finds that the implementation of personnel agency is the result of the joint promotion of the policy in the strong sense of the government and the interest drive in the weak sense of colleges and universities.However,due to the lack of input of basic institutional resources,the current personnel agency reform still belongs to the second level of supply.It does not have the ability to rebuild the strategic goal of“social contractor”in public colleges and universities.Therefore,we can try to optimize the reform of personnel agency system in colleges and universities from the aspects of strengthening institutional ethics,increasing institutional supply and adopting the rule of law,to promote college teachers flow rationally.
