摘　　要：法律与文学课程教学以当代中国的法律与文学研究为基础,后者以文学中的法律研究为主流,这种研究体现了对中国传统的继承和对中国问题的关注,而不是对西方理论的简单模仿。法律与文学课程应定位为通过文学作品探究中国法理,其对民间法理的呈现在教学和研究中具有不可替代的作用。法律与文学具有研究性课程的性质,能够通过适当的文本选择呈现家族法理、市井法理与江湖法理,学生阅读与研究能力的提高主要通过合理安排论题、精心布置作业以及巧妙命制试题等环节实现。The course of law and literature is based on contemporary Chinese law and literary studies,and the legal study in literature is the mainstream in the course.This kind of research reflects the inheritance of Chinese tradition and the concern for Chinese social issues,rather than the simple imitation of Western theories.The course of law and literature should be positioned to explore Chinese jurisprudence through literary works.This course has an irreplaceable role in the teaching and research of folk jurisprudence in China.The course of law and literature is a research-based course that presents family jurisprudence,market jurisprudence,and social jurisprudence through appropriate choices of the texts and classical works related to law.Through reading and research,students can improve their knowledge and abilities,and the course can help students achieve their abilities through reasonable placement of course topics,assignments or exams.
