摘  要:将《民法学》与《民事诉讼法学》两门课程合并为《民法学与民事诉讼法学的原理与实务》是法律硕士教学改革的重大突破。民事法学"形散"背后蕴含着实质上"神合"的巨大潜力。民事法学的双重属性使"民事法学一体化教学"应运而生并成为迫切需要。民法典在编撰过程中需要确保与民事诉讼法之间的平衡、协调与统一;民法典的登场要求"民事法学一体化教学"必须理念创新。以"案例教学法"为基本依托,"新五定法"所倡导的定事、定性、定法、定例、定判符合逻辑规律与办案实际,为深入推进"民事法学一体化教学"提供了新的方法论指导。It is a significant reform to integrate Science of Civil Law with Science of Civil Procedure Law to form a course entitled Theory and Practice of Science of Civil Law and Science of Civil Procedure Law,for the advantages of both courses are taken good care of,and thus the integrated one is a good balance in several respects between the two.Based on the"teaching method of case study"and a"new legal theory concerning five determinations,"the reform serves as a methodological guide to promote the"integrated teaching of Science of Civil Law and Science of Civil Procedure Law."
