摘  要:基于学术史视角,以学科的基本要素为判断标准,发现我国教育法学研究自产生以来,历经萌芽期、初具形态期、迅速发展期三个发展阶段,目前作为相对独立的学科开始走向成熟。在教育法学发展的不同阶段,研究的目标与主题具有高度一致性,对我国教育法治实践做出了积极回应。表现为:呼吁教育法的制定和教育法体系的建立,推进教育事业发展有法可依;强调学生权利保护,推动司法在教育领域的介入以及公正司法;关注教育实践中的法律问题,推进依法治校;全面研究教育立法问题,推动教育事业发展的良法之治。针对学科理论建构与证成方面存在的缺憾,未来应将教育法学学术史作为教育法学研究的基础,形成教育法学的学术传统与学术规范;着眼提高教育法学研究的学术性,建立教育法学的学术根基和理论体系;注重教育法学研究的本土化,形成中国教育法学的性格和思想领地;强化教育法学内含学科的融合与联系,探索教育法学研究的生长点和理论突破。Based on the perspective of academic history and the basic elements of the discipline,it can be perceived that the research of educational law in China has gone through three stages of development since it came into being,namely,the embryonic stage,the initial formative stage and the rapid development stage,and now it is becoming mature as a relatively independent discipline.It is found that in different stages of the development of educational law,the research objectives and themes are highly consistent,which has made a positive response to the practice of the rule of law in education in China.It is shown as follows:(1)calling for the formulation of education law and the establishment of education law system to ensure that there are laws to follow in the development of education;(2)emphasizing the protection of students’rights to promote the judicial intervention in the field of education and judicial justice;(3)paying attention to legal issues in educational practice to promote the administration of schools in accordance with the law;and(4)studying the issue of education legislation comprehensively to promote the development of education by the rule of good law.Therefore,in view of the deficiencies in the construction and certification of discipline theory,the following suggestions should be adopted in the future:taking the academic history of educational law as the foundation of educational law research to form the academic tradition and academic norms of educational law;aiming at improving the academic nature of educational law research to establish the academic foundation and theoretical system of educational law;paying attention to the localization of education law research to form the character and ideological territory of Chinese educational law;strengthening the integration and connection of the disciplines covered by educational law to explore the growth point and theoretical breakthrough of educational law research.
